right to strike
The
right to strike is one of the
labour rights in Canada. Most labour unions
? have the right to strike, although there is a process that must be followed before the strike is a "legal" strike. A "wildcat strike" is a strike that does not follow due process and may or may not be sanctioned by the union itself.
[+] Essential Services
Some unions, are involved in work deemed an "essential service" by the government, in cases where the withdrawal of that service would cause undue danger or disruption to the public. Examples of essential services are Fire fighters
?, Police
? and Ambulance
? services.
[+] Back-to-Work Legislation
In some cases of labour disputes in the
public sector and the
private sector the federal government
? or the provincial government
? have intervened to legislate an end to a strike in a one-time fashion. Examples are the CN/CP Rail workers strike in 2005 which was legislated "back-to-work" by the
Martin Government of the day. because of the extreme impact on the Canadian economy. In 2008 a sudden strike by Toronto's TTC workers prompted back to work by the McGuinty Government
?, and public transit
? was, for the first time in Canada, deemed and essential service.

[+] Extend Essential Service designation to most of the public sector.
The public sector needs unions because of the difficulty in dealing with political bosses, but the right to strike is inappropriate in many cases (teachers, nurses, transportation) where a strike brings major disruption, economic losses and safety risks to everyone else. Arbitration can be made to work for the public sector, and hopefully it will help make the
public service more efficient.
